HOME 2025 Final Rule: Tenant Protections Indefinitely Delayed – What Owners/Agents Need to Know
As of April 29, 2026, HUD has indefinitely delayed the effective date regarding tenant protections and selection.
Back on April 17, 2025, HUD published the HOME Investment Partnerships Program Updates and Streamlining—Delay of Effective Date, Withdrawal, and Correction Notice which delayed the effective date for the HOME 2025 final rule tenant protection and selection provisions 24 CFR 92.253 until October 30, 2025, while allowing a majority of the HOME Final Rule provisions to go into effect on April 20, 2025.
HUD went on to further clarify in the notice that while most of the 2025 final rule became effective on April 20, 2025, grantees would be given until April 20, 2026, to follow the provisions implemented on April 20, 2025.
On October 22, 2025, HUD sent notice that the effective date to implement tenant protection and selection provisions was further delayed from October 30, 2025, until April 30, 2026.
As of April 29, 2026, HUD has indefinitely delayed the effective date regarding tenant protections and selection. HUD is indefinitely delaying these provisions so it can take additional comments on these changes.
HUD stated it plans to publish a proposed rule and after it reviews any comments, it will issue a final determination regarding these provisions.
Here is what Owner/Agents need to know:
- The new tenant protections under revised 24 CFR 92.253 are not yet required.
- Existing/current tenant protection requirements remain in place until HUD finalizes the new rule.
- Owner/Agents should continue following the current HOME program lease requirements, termination protections, and tenant selection requirements already in effect.
